It has been reported that the leadership of the Democratic Party of Korea has decided to hold off on pursuing impeachment in relation to Prosecutor General Shim Woo-jung. The Democratic Party protested against the prosecution’s decision not to indict First Lady Kim Kun-hee on charges of manipulating the stock price of Deutsche Motors and announced the impeachment of President Shim and others. However, as there are reactions within the party that the legal requirements for impeachment are insufficient to establish the legal impeachment requirements because Shim did not exercise investigative command authority in the relevant investigation, and that there are concerns about backlash from the public due to excessive impeachment, it is interpreted that they are trying to put it on hold for now. However, the impeachment of Seoul Central District Prosecutors’ Office Chief Lee Chang-soo and Seoul Central District Prosecutors’ Office Anti-Corruption Investigation Department 2nd Chief Prosecutor Choi Jae-hoon will proceed as scheduled and the impeachment bill will be processed at the plenary session of the National Assembly on the 28th of next month.

According to multiple key Democratic Party officials on the 29th, the Democratic Party decided not to raise a motion to impeach President Shim at the plenary session on the 28th of next month. One leadership member said, “On the 28th, we plan to only handle the impeachment motion against Chief Prosecutor Lee and Chief Prosecutor Choi,” adding, “In the last National Assembly Legislation and Judiciary Committee audit, Prosecutor General Shim said, ‘I will exercise my right to lead the investigation if an appeal regarding Ms. Kim’s suspicions proceeds.’ “Now that we have revealed that, we will be watching to see how the investigation is conducted in the future.” A member of the floor leadership also said, “Didn’t Prosecutor General Shim say that he would change his attitude and personally take care of the investigation as he was likely to be impeached?” and added, “As for Prosecutor General Shim, we will take a closer look at the situation before proceeding.”

It is reported that the prevailing view within the Democratic Party leadership was that it would be unreasonable to attempt to impeach Prosecutor General Shim, who had no authority to lead the investigation. An official from the floor leadership said, “President Shim was appointed last month when the investigation into allegations of stock price manipulation was in the final stage,” and added, “It is true that it is difficult to hold him accountable, both legally and politically.” We also took into account the fact that if the impeachment bill is dismissed, there may be increased public criticism that the major opposition party is excessively promulgating the impeachment bill. A leadership official said, “The weight of impeaching the head of the prosecution itself could actually bury Ms. Kim’s suspicions.”

An official from the Democratic Party’s floor leadership said, “The impeachment bill against Chief Prosecutor Lee and Chief Prosecutor Choi will begin work on the impeachment bill in earnest once the National Assembly Steering Committee’s audit of state affairs and the off-site rally to condemn Mrs. Kim are completed early next month.”

On the 23rd, the Democratic Party reported Chief Prosecutor Lee, Chief Prosecutor Choi, and 4th Deputy Chief Prosecutor Cho Sang-won of the Seoul Central District Prosecutors’ Office to the High-ranking Public Officials Crime Investigation Office on charges of dereliction of duty related to the investigation into Ms. Kim.
