Gersheim (Saarland) – Your nerves are on edge. Isabelle (56) and Jürgen Rebmann (65) have been fighting in court for their rights for 13 years because their home in Herbitzheim resembles a ruined building. They feel abandoned by the judiciary, are already talking about process fraud and have filed a supervisory complaint against the responsible chamber at the Saarbrücken regional court.

So far they have only achieved partial success in the year-long dispute with the Saarland property developer: in July the court awarded the couple 100,000 euros. But no money has flowed yet. The other side has taken further legal steps.

The developers fear that they could come away empty-handed. According to them, the property developer has now changed its company name. Jürgen Rebmann told BILD: “We are afraid that the old company could soon no longer be solvent and disappear completely.”

For him, one thing is certain: the court will be partly to blame if this construction nightmare occurs because, in his view, the process is constantly being dragged out. “We all have that Construction errors documented and presented. We are no longer allowed to enter our house because of the risk of collapse.”

Your lawyer Dr. Claudius Taubert (Trier): “The list of construction defects is long. They were fraudulently concealed. The criminal offense of endangering construction is in the room. The building contractor tries to downplay the defects. Renovation is not being considered. The house has to be demolished.”

According to him, the Rebmanns’ claim now amounts to around half a million euros. And there is a threat of further reports, the costs of which his clients would have to financially cover.

One Petition The Rebmanns have now also submitted it to the Saarland state parliament, in which they complain, among other things, about a “delay in the process” and demand transparency. Attorney Taubert: “The courts treat the construction company with kid gloves and try to force my clients into a settlement that is unfavorable to them.”

Many have thrown in the towel a long time ago, says Taubert. “But the Rebmanns are fighting, even if they have now lost faith in a functioning constitutional state.”
