As the Democratic Party of Korea announced on the 24th that it would propose an impeachment bill against Acting President Han Deok-soo, the battle between the ruling and opposition parties over the requirements for impeachment of the acting president is intensifying.

The Democratic Party claims that the legal status of Acting President Han is Prime Minister, not President, and that the majority of registered lawmakers (151), which is the quorum for impeachment of the Prime Minister, supports the motion. CEO Lee Jae-myeong said on this day, “There is no position called acting authority. “There are only cabinet members who act on behalf of the president,” he said.

On the other hand, the People Power Party maintains that “the position of acting president is equivalent to that of the president,” and requires the approval of more than two-thirds (200 members) of the registered lawmakers, like the president. Acting Representative Kwon Seong-dong said, “Even if more than 1/2 of the National Assembly (enrolled members) agree, it is a clear violation of the Constitution, so an acting representative must continue to carry out his duties.” The People Power Party plans to file a request for a power dispute adjudication to the Constitutional Court if the impeachment bill against an acting president is passed with a majority vote of 151 people. Article 65 of the Constitution provides for the impeachment of the President, Prime Minister, and State Council members, but does not provide for acting President.

National Assembly Speaker Woo Won-sik, a member of the Democratic Party, also said on the same day, “I understand that the Legislative Research Service, an agency of the National Assembly, recently issued an opinion in the form of answers to questions from members of the National Assembly,” and added, “We will carefully consider these points and make a decision.” Chairman Woo emphasized, “The primary judgment (on the quorum for voting) is made by the chairman.”

Cho Han-chang, a candidate for Justice of the Constitutional Court recommended by the People Power Party, responded to a question from Democratic Party lawmaker Park Joo-min, who asked at the National Assembly personnel hearing on the same day, ‘How do you view the interpretation that impeachment by the National Assembly Legislative Research Service for issues during his time as Prime Minister is possible with the approval of a majority of registered members?’ He said, “As for the Prime Minister’s duties, it seems that (the approval of a majority of registered lawmakers) meets the requirements for impeachment under the Constitution.”
