The Human Rights Research Institute (IRDH) welcomes the convening of the electorate for the presidential election of December 20, 2023 by the Independent National Electoral Commission (CENI). The Institute congratulates Mr. Augustin Matata and Mr. Constant Mutamba, the first to submit their applications to the Applications Reception and Processing Office (BRTC). IRDH encourages any other person who has met the criteria to do the same, peacefully.

The sensitivity of the electoral context calls on those responsible for public institutions to exercise caution and greater responsibility towards the process and the stakeholders. Any act tending to compromise the security of candidates, the transparency and traceability of the vote will undermine the legitimacy of the vote.

As a result, the IRDH condemns the cavalier procedure of the arrest and arbitrary detention of journalist Stanis Bujakera by Demiap soldiers. This is a form of violation of arts. 18 and 19 of the Constitution which guarantee any person to be IMMEDIATELY informed of the reasons for their arrest, to enter into contact with their family or with their counsel and not to be removed from the judge that the law assigns to them.

With regard to Matata, IRDH believes that as soon as it becomes involved in the electoral process, the opportunity for prosecution changes. Any legal proceedings against a candidate will amount to the disruption of the electoral process by the judiciary and risks constituting a source of political tension. Especially since the person targeted had left his position as Prime Minister since December 20, 2016.

Furthermore, IRDH recommends to the President of the Republic, Felix-Antoine Tshisekedi Tshilombo, head of state and supreme magistrate, to ensure the release of emblematic politicians, like Salomon Idi Della Kalonda Salomon whose health has deteriorated. seriously deteriorated since his detention on May 30 at Ndolo military prison. Such a measure would largely contribute to easing the political climate during the electoral campaign.
