Lubumbashi, September 11, 2023. The Human Rights Research Institute (IRDH) is pleased to have obtained the transfer of the accused Salomon Idi Della Kalonda to a medical center, due to the advanced deterioration of his state of health in prison. However, IRDH believes that on the eve of the general elections in December 2023, the President of the Republic should take additional measures to ease the political climate.

Indeed, since September 12, the director of the Ndolo Military Prison has transferred the inmate Kalonda to a medical center more equipped than his dispensary. Certainly, the decision is laudable. However, it should be in a package of measures aimed at regulating the ENTIRE electoral process. Last July, IRDH, ACAJ, ASADHO, VSV, ANMDH and JUSTICIA had already requested the intervention of the National Commission on Human Rights (CNDH), in order to obtain the release of emblematic political prisoners, like by Salomon Kalonda, Len’s Omelonga and Jean-Marc Kabund-a-Kabund. To date, Stanis Bujakera Tshiamala has reached fifty.

For the IRDH, it emerges from the will of the people (primary sovereign) that the priority for 2023 is the holding of elections leading to the renewal of the mandates of the President of the Republic and the members of the deliberative assemblies constituting the Legislative Power. To a large extent, these elections aim to change the face of the Executive.

Therefore, as by law, it is the constitutional responsibility of the leaders of the Judicial Power to monitor the conformity of the acts of the Independent National Electoral Commission (CENI), to validate its decisions and to resolve possible conflicts between it and the competitors. in the election, or, among the competitors, themselves. The judiciary plays the role of last bastion for all stakeholders in the election. It is supposed to guarantee equal opportunities for all. A fortiori, the President of the Republic, supreme magistrate and constitutional guarantor of the Nation, has the duty to secure the ongoing electoral process.

In this way, the Judiciary can delay any procedure perceived as aiming to disadvantage a political competitor and which would expose the electoral process to social unrest. If the electoral context seems to have postponed the opportunity for prosecutions against politicians presumed to be perpetrators of economic crimes, let it be the same in favor of political prisoners accused of endangering state security. Moreover, it appears that Fortunat Biselele and Franck Diongo benefited from such largesse. Such measures would be beneficial to easing the political climate during the electoral period.
