The administrative responsibility for not appearing for a health check-up at the time specified in the summons is a warning or a fine of up to 350 euros. The fines applied vary, but none of the conscripts have been fined more than €50.
The application of the administrative penalty does not relieve the obligation to perform a health examination, the conscripts are transferred to the next conscription, the ministry stated.
The law does not provide for criminal liability for evasion of national defense military service. The military police can impose fines of between 50 and 5,000 euros for failure to appear at the duty station.
The decision on the amount of forced money is made by the Military Police. If the forced money is not paid voluntarily, the executive order issued by the Military Police is handed over to a sworn bailiff for forced execution, applying the provisions of the Civil Procedure Law on the recovery of sums of money, the ministry said.
Compulsory payment of money does not release from the obligation imposed by the administrative act – to appear at the place of performance of the service. Also, the Military Police can forcibly take the conscript to the place of duty.
Currently, the Ministry of Defense has handed over to the Military Police five cases related to conscripts who have not voluntarily complied with the decision of the Ministry of Defense issued for them to be called up to the national defense military service, arriving at the place of duty at the time specified in the decision, the ministry said.
It is planned to bring these conscripts to the place of service under compulsion, as well as apply a fine of 50 to 5000 euros.
It has already been reported that the first SAD enlistment began its service in July 2023 on a voluntary basis and ended it in May 2024. On the other hand, on January 23 of this year, the selection of candidates for the National Defense Service took place for the first time on a random basis.
On June 15, 2024, applications for the January 2025 conscription closed, within the framework of which volunteers will be able to serve in the NBS unit, the National Guard, as well as in the reserve officer program.
Citizens of Latvia are also invited to join voluntarily in future conscriptions. However, if necessary, the missing number of persons aged between 18 and 19 will be conscripted on a random basis, by sending the decision on conscription to the national defense service to an electronic address or the declared address of residence, or it will be delivered personally.
