Delhi: Sportswear brand Adidas has lost its trademark infringement case against American luxury fashion brand Thom Browne Inc. Adidas accused Thom Browne of using a logo similar to theirs. Thom Browne uses four lines. Adidas logo has three stripes.

Adidas aimed to recover more than $7.8 million in damages from Thom Browne. That is about 63 crore rupees. But the court verdict was against Adidas.

Thom Browne’s legal team argued that there was no time between the two companies’ logos, pointing out that the two brands serve different customers. Thom Browne Company does not dominate the sportswear sector.

The dispute between the two companies had been going on for more than 15 years. In 2007, Adidas complained about the use of a three-stripe design on Thom Browne jackets. Brown then stopped using it and added a fourth line. Following the sale in 2018, Adidas was upset that the brand received more attention. Since then the Thom Browne brand has grown rapidly and is now traded in more than 300 locations worldwide. The BBC reported that Thom Browne plans to make more athletic clothing in recent years.

Thom Browne said there was no likelihood of confusion between the companies’ designs because they “operate in different markets, serve different customers and their products trade at different price points,” lawyers for the Thom Browne brand said.

Since 2008, Adidas has filed more than 200 settlement agreements and been involved in more than 90 court cases related to its trademark.
