The Madras High Court dismissed the cases filed by famous composers AR Rahman and GV Prakashkumar against the levy of service tax on music works. In 2019, the commissioner of GST, also known as Goods and Services Tax, has issued an order to pay service tax of 6 crore 79 lakh rupees to famous music composer AR Rahman.

In 2020, music composer AR Rahman filed a case in the Madras High Court seeking cancellation of this order. He had stated in the petition that after permanently giving the copyright of the music works to the film producers, they were the owners and it was illegal to collect tax from him. He had also said that this order has been issued to tarnish his reputation.

In this case GST In the reply filed by the Commissioner, it was stated that the notice was sent to AR Rahuman based on evidence of tax evasion and there was no intention to tarnish his reputation. GST It was also said that this case, which was continued without getting a solution after appealing to the department, should be dismissed.

Similarly, music composer GV Prakashkumar had also filed a petition against the notice sent by the GST Commissioner asking him to pay service tax of Rs 1 crore 84 lakh.

Judge Anita Sumant, who heard these cases, dismissed music composer AR Rahman’s plea as not suitable for trial. Also, GST GST objected to the Commissioner’s order. He also ordered that an appeal can be filed with the Appellate Authority within four weeks.

GST Dismissing the petition filed by music composer GV Prakash Kumar against the notice sent by him seeking explanation regarding the imposition of tax, Justice Anita Sumant directed GV Prakash Kumar to respond to the notice sent by the GST Joint Commissioner to the concerned authority within four weeks.
