The Federal Supreme Court (STF) formed a majority to overturn a law that prohibited the use of the so-called “neutral language” in public and private schools in the state of Rondônia. Law 5.123 had been sanctioned by Governor Marcos Rocha (PSL) and had already been published in the Official Gazette on October 19, 2021.
Minister Edson Fachin, rapporteur of the case, had already suspended the law. The judgment then went to the virtual plenary of the STF, where the other ministers vote without the need for discussion.
So far, ministers Alexandre de Moraes, Ricardo Lewandowski, Cármen Lúcia, Dias Toffoli and Roberto Barroso have voted to overthrow the law. Justices Luiz Fux, Gilmar Mendes, André Mendonça, Nunes Marques, and the president of the Court, Rosa Weber, still need to vote.
The main allegation presented by the magistrates in favor of overthrowing the law is that it is not up to the state of Rondônia to establish rules about the state school curriculum, but the federal government.
“It is up to the Union to establish competence and guidelines for early childhood education, in order to ensure common basic training. This is because, within the scope of concurrent competence, it is up to the Union to establish minimally homogeneous rules throughout the national territory”, declared Fachin, who was accompanied by the majority.

Neutral language is the distortion of the use of written language in order to meet the interests of the LGBT+ movement. Its supporters defend the use of expressions such as “todes”, “amigos” or “todxs” and “amigos”, instead of “todos” and “amigos”, claiming that this change would be more “inclusive”.
This is because, the argument based on gender ideology argues that the current language would not contemplate “non-binary” people. That is, those who do not identify themselves (psychologically) by the male and female sexes/genders.
For the pastor and federal deputy Marco Feliciano, the neutral language is the result of an ideology that aims to deconstruct the values of the traditional family.
“This disastrous ‘neutral language’ is only defended by teachers and pedagogues with a leftist background, coming from PT schools who, over the last 14 years, have invested in Marxist indoctrination of family deconstruction”, commented Feliciano.
