The Treasury agrees with Tecniberia in its dispute with Aena

He Central Administrative Court of Contractual Appeals (TACRC)a body under the Ministry of Finance, has agreed with the employers’ association of engineering companies, Tecniberiain his appeal against an Aena bankruptcy.

In a resolution dated February 9, the TACRC upholds the appeal filed last September against Aena’s tender document “Service for the development, implementation and monitoring of the BIM Methodology (Building Information Modeling) Phase II”. The BIM (Building Information Modeling) methodology is a collaborative work system for the conception and management of building and civil engineering projects.

The TACRC has rejected Aena’s arguments for using the electronic auction, not establishing a limit to reckless bids (abnormally low) and not considering the weight of technical assessment in the final assessment of bids.

In a statement, this employer highlighted that with this resolution the TACRC “reindicates to Aena that they have to contract engineering consulting services, considered intellectual services, prioritizing quality criteria over economic ones”. Likewise, the parameters to identify the offers initially involved in presumption of abnormality must be established in the PCAP (Pliego de Cáusulas Administrativas Particulares), adds the note.
