Elisabeth Borne intends to show that she has consideration for the social partners. On Monday, February 20, the Prime Minister made a commitment to transcribe into law, in a way “faithful and total”a draft national inter-professional agreement (ANI) recently drawn up by employers and unions on “the sharing of value within the company”. “We will respect the compromise reached”she said, seeing a “historic breakthrough” for women and men working in small companies. Within the majority, however, there are a few who want to go a little further.

The promise of M.me Borne was made at a convention of Renaissance, the presidential party, devoted to the redistribution of wealth created by companies. The ANI, which must be transposed into law, was finalized on February 10 after three months of negotiations. It is intended to serve as a toolbox to improve the remuneration of workers, in a context where soaring prices are cutting off the purchasing power of millions of households.

Among the provisions of this text that attract attention, there is one that applies to companies with 11 to 49 people: they will be required to establish a mechanism “legal value sharing” (profit-sharing, incentives, etc.) if they generate, for three consecutive years, a significant profit, at least equal to 1% of their turnover. With regard to companies with at least 50 employees, discussions will have to be opened in order to “better take into account exceptional results” made in France. A measure that resonates with the debate, launched since several laws, on superprofits.

At this stage, the text has been approved by the CFDT, the CFTC and the three employers’ movements (Medef, Confederation of small and medium-sized enterprises, Union of local businesses). Force Ouvrière will give its position on Wednesday February 22, while the CFE-CGC will do so five days later. As for the CGT, its decision will fall on February 28 and will most likely be negative.

Any unraveling would be “a stab”

Among the organizations that have already signed up, several of them insisted that the ANI be transposed into law as it is. “Any unraveling of this agreement would be for me a stab in the back of the social partners! »declared Geoffroy Roux de Bézieux, the president of Medef, on Sunday February 19 on Europe 1. The next day, Laurent Berger, the number one of the CFDT, hammered out an identical speech: “The agreement must be respected by Parliament. » Mme Borne therefore gave them their case on Monday.
