The Biden administration has published a proposal that would disqualify some immigrants from US asylum and allow the government to quickly deport them, saying major policy change is needed to stem illegal immigration to the southern border.

Immigrants who cross the southern border illegally after failing to seek humanitarian asylum in another country, such as Mexico, would be ineligible for US asylum. Those who cannot prove they are not barred from seeking asylum under the law can be quickly deported without even being given a chance to see an immigration judge.

Under the new rules, immigrants who do not schedule an appointment at a US border port of entry will not be granted asylum, except in certain cases. In order to gain asylum in the United States they must first seek and be denied protection in the countries they pass through.

The Departments of Justice and Homeland Security, which oversee judges and officers who review asylum cases, will give the public 30 days to comment on the proposed regulations before implementing them. The government told the Supreme Court earlier this month that it plans to finalize the regulations by early May.
