Justice of SP gives 72 hours for EBC and União to provide information about Janja’s live

The decision was handed down this Monday, 13th, in the context of a popular action by São Paulo councilor Rubinho Nunes (União Brasil)

The Federal Court of São Paulo granted 72 hours for the Union and the EBC (Empresa Brasil de Comunicação) to provide information about the “Papo de Respect”, a program presented by the first lady, Janja Lula da Silva, through a live on the channel from TV Brasil on YouTube on the 7th.

The decision was handed down this Monday, 13th, in the scope of the popular action authored by São Paulo councilor Rubinho Nunes (União Brasil), and is signed by the judge of the 25th Federal Court of São Paulo, Djalma Moreira Gomes. The order is only subpoena – and not summons, which does not open the defense period – and does not include the first lady.

To Estadão, the current president of the EBC, Hélio Doyle, said he had not yet been notified. “We are calm, there is no illegality or irregularity.” He attributes this and other lawsuits questioning the live to a “natural” movement of political opposition.

In addition to Nunes, there are at least two more parliamentarians asking in court to withdraw the live.

One of them is federal deputy Kim Kataguiri (União Brasil-SP), author of another class action that is being processed in the Federal District. Although there is still no decision in this process, the Union manifested itself this Tuesday, 14, asking that Djalma Moreira Gomes’ prevention be recognized.

If the request is accepted, Kataguiri’s process may be joined to Nunes’.

The other parliamentarian is Carmelo Neto (PL), federal deputy from Ceará. This Monday afternoon, he also filed a class action, before the Federal Court of his State. The cearense request does not include the first lady as a defendant.

The live, broadcast on the night of the 7th, had gender violence as its theme, given the proximity to International Women’s Day. Janja interviewed Cida Gonçalves, Minister of Women in the current administration.

The main request of parliamentarians is that the live be removed from the air through the granting of preliminary injunctions – urgent decisions. However, as a rule, this type of decision is not appropriate against acts of public power – a rationale mentioned by Djalma Gomes. The popular action law makes an exception for cases where there is proof of damage to public property

Questioned about this Monday’s decision, Janja’s advisors said they will not comment on the content of the lawsuits.
