The legal profession must know how to adapt to this new reality without losing the essence of the profession and its most traditional ethical values.
The approval at the beginning of the 21st century of the so-called internet law put into question the old controversy existing on the net: a latent pulse between freedom of information and the right to privacy. The fear of computer crimes, the enormous economic potential of this global multimedia network and, above all, the abysmal difference in knowledge between simple users and seasoned experts, places the latter under permanent suspicion.
Hackers, crackers y phreackers These are terms that come to mind when it comes to exposing the weakness of the computer system and the use of modern technologies, and even more so those individuals who cross the border of legality and enter the field of what is known as “computer criminals”: responsible for electronic theft, interception of online purchases for their own benefit or forgery of credit cards by duplicating magnetic stripes, among other possible illegal acts.
The application in Spain of both this law and the subsequent legislation on electronic signatures, with the implementation of the digital DNI and the reliability in the identification of the navigator, was, without a doubt, a turning point in the field of cybersecurity in our country. , to which must be added a specific punitive classification in the Penal Code for cases of computer hacking and other crimes committed using the network.
However, all this legislation, although it has served to alleviate the absence up to now of a specific regulation in this regard, has not, however, prevented the proliferation of computer risks.
