Supreme Court notice on the petition against the division of property on the basis of Sharia law

New Delhi: The Supreme Court issued a notice on the petition against the division of property based on Sharia law. The Supreme Court issued a notice to the opposing parties on a petition filed by Mumbai-based Bushara Ali against partition of a family property in Vadakara under Sharia law. The Supreme Court also directed to continue the status quo in the case.

Bushara Ali argues that there is no gender equality in the division of property under Section 2 of the 1937 Sharia Act. Advocates Bijo Mathew Joy and Manu Krishnan, appearing for Bushara Ali, argued that female children in the family do not get equal rights like male children owning property.

But advocates PS Zulfiqar Ali and KK Saidalavi, appearing for the opposing parties, pointed out in the Supreme Court that the property had been given to Bushara. A bench comprising Justices Krishna Murari and Sanjay Karol orally observed whether the sons should take over the property without giving it to the daughters.

The lawyers of the petitioners demanded that this petition be tagged along with the petition pending before the Supreme Court, alleging that the succession law implemented in Muslim families under Sharia law is unconstitutional. But the Supreme Court did not accept this demand.
