Eight practitioners at the football legend’s bedside at the time of his death on November 25, 2020 from a cardio-respiratory crisis are charged with homicide with potential aggravating circumstances.

Was Diego Maradona properly taken care of by health personnel? The Argentine justice confirmed this Tuesday April 18 on appeal the upcoming trial of eight health professionals, who had been sent to justice last year for potential negligence which led to the death of the Argentine legend in 2020.

According to prosecutors, the personnel in charge of Maradona had been “protagonist of a home hospitalization […] totally deficient and reckless”marked with a “series of improvisations, mismanagement and shortcomings”.

In its resolution on Tuesday, the Appeals Chamber of the Court of San Isidro (northwest of Buenos Aires) questioned “the behavior that each of the defendants would have adopted, not respecting the mandate to act that good medical practice dictated to them” to heal the Argentine legend.

In June 2022 a judge from San Isidro, following the requisitions of the prosecution, had sent eight practitioners to trial, including a neurosurgeon and attending physician, a clinical doctor, a psychiatrist, a psychologist, a head nurse, nurses. All remain free.

This Buenos Aires court had heard in March the arguments of these professionals, who appealed in 2022, accused of homicide with potential aggravating circumstances. They challenged either the dismissal, or the chosen leader, claiming for some a requalification in manslaughter.

The Appeals Chamber maintained the initial qualification of “homicide with dolus eventualis”, ie a serious offense when a person commits negligence knowing that it can cause death. She is liable to 8 to 25 years in prison.

The trial not before 2024

Maradona, icon in Argentina and myth of world football, died of a cardio-respiratory crisis on November 25, 2020 at the age of 60, alone, on a medical bed in a residence in Tigre, north of Buenos Aires, where he was recovering from neurosurgery for a hematoma on his head.

No date has been communicated by the Buenos Aires court for a trial, which should not be held before 2024.
