The Social Chamber of the Supreme Court has declared the nullity of a section of the II Collective Labor Agreement of the Supermarkets and Self-Service Food Stores of Catalonia, referring to the province of Girona, which required paying 10 percent more, in concept of eventuality bonus, to workers in the sector hired by Temporary Employment Agencies (ETTs) than to those hired directly by supermarkets. The court considers that the questioned paragraphs cause “serious damage” to temporary employment agencies since they “deprive temporary employment agencies of being able to remunerate their assigned personnel under the same conditions as user companies. By force, the extra cost involved in the obligation to pay a higher remuneration discourages the formalization of employment contracts.
