During the last hours a debate has been generated within the medical community. All part of a small modification to the General Health Law that could generate great consequences. The point of discussion is a proposal that has been baptized by its detractors as the Ley Chucky. If you still do not know what it consists of or all the implications it could have, then we will explain it to you.

First of all, the legal part is fundamental in all areas and more so in the health sector. The problem is that not everyone pays enough attention or is interested in this area. In no way should be neglected because the consequences can be from conflicts to lawsuits for Medical negligence.

However, this inconvenience is so frequent that it is estimated that most physicians will experience at least one legal confrontation in their career. Although it should also be clarified that not all proceed because many are resolved before their conclusion. In addition, it is not always the fault of the doctors because sometimes those responsible are the patients or the hospitals themselves.

Chucky law, origin of new conflict between doctors

The origin of everything is a reform to article 79 of the General Health Law. It has already been approved by the Chamber of Deputies and is now under discussion by the Senate. What it raises isadd the term “aesthetic” to reconstructive plastic surgery.

It seems like a minor modification but in reality it would have great repercussions. The opposition doctors affirm that the maximum beneficiary would be a civil association that regulates the reconstructive plastic surgery clinics.

At the same time, it would harm patients because it causes confusion by assuming that a general practitioner with a surgical seminar is the same as a specialist.

Among those who oppose this bill is the doctor Noé Reyes, who affirmed that the proposal baptized as Ley Chucky it only seeks to favor an association that has ties to former President Felipe Calderón. He also said that it will generate a monopoly that will affect thousands of specialists in the country.

He also accused the existence of possible acts of corruption by the Ministry of Health. He added that by allowing this initiative to advance, the National Regulatory Committee of Medical Specialty Councils (CONACEM) is strengthened. It is a private body that to date generates disgust among health professionals.

What is CONACEM?

It was founded in 2011 and since then it has been the body in charge of evaluating the capacities of specialists. In theory, it is a positive aspect because it requires doctors to update themselves periodically to properly care for patients.

While one of the inconveniences lies in the increase in bureaucratic procedures. Some medical certification exams now cost up to 30,000 pesos. But perhaps the most serious thing is that there are also suspicions of alleged illegal acts.
