“Fortnite” dispute: Apple also wins before the US Court of Appeals

Apple also prevailed against the company Epic before the Court of Appeal. The “Fortnite” makers also fail in the second instance with the attempt to avoid the required fee to the tech group.
Apple has also prevailed in a dispute with the makers of the online game “Fortnite” before the Court of Appeal. The judges left the decision of the lower court in force, in which the iPhone group was largely right. According to the judgment, they found an error in defining the relevant market – but classified it as unimportant.
The “Fortnite” developer company Epic wanted to avoid the 30 percent levy on the purchase price that Apple withholds from transactions in its App Store. In 2021, she resorted to a trick: a version of the application was smuggled past the app inspectors, with which users could also buy virtual items past Apple. Apple threw “Fortnite” from the App Store because of the rule violation. Epic then accused Apple of unfair competition, but lost on most counts in the district court.
At the same time, however, the court of appeal left a decision of the lower court in force, according to which Apple should make it easier for app developers to point out purchase options outside of the app store. The iPhone group wanted to overturn that.
