WASHINGTON (Reuters) – U.S. President Joe Biden said on Tuesday he was considering invoking the Fourteenth Amendment to the U.S. Constitution even as he continues talks to end a deadlock over the debt limit, but that to do so would require legal action.

In effect, Biden, a Democrat, would test the constitutionality of the $31.4 trillion US debt limit that is currently the subject of negotiations between the president and US House of Representatives Kevin McCarthy, a Republican.

“When we get through this, I’m thinking of taking a look at the months ahead to see what the court would say,” Biden told reporters. “I’ve been considering the 14th Amendment,” but “that would have to be litigated,” she added.
