Codacons filed a complaint with the prosecutor for a new final vote review

New deed of case ‘Dancing with the Stars’, whose latest edition had ended up at the center of a controversy linked to the social votes for the artists in the competition. According to time.news, in fact, Codacons filed a complaint with the Rome Public Prosecutor’s Office submitting a new request for a review of the documentation regarding the results “of public votes collected through social networks, including minutes, printouts, and every document where all the votes received have been noted and recorded, none excluded, even those coming from the alleged ‘false profiles’ with reference to the final episode of the program ‘Dancing with the Stars’ ‘ aired December 23″.

Let’s reconstruct briefly the story. The day after the closure of the program won by Luisella Costamagna, Codacons and the Association of Radio and Television Services Users presented a formal request for access to Rai aimed at knowing all the results of the public votes collected through social networks. “An instance that did not enter into the merits of the classic final of the match, but followed the many requests for intervention received from viewers”, Codacons himself explained at the time. But Rai, in a reply note, had refused to provide the two associations with what they requested, not recognizing an automatic direct interest of the consumers’ association in the request for access to the documents. Specifically, the document stated that “the associations blatantly intend to review the legitimacy and transparency of the programming of the undersigned public service concessionaire without any ownership or competence being attributed to them by law”.

The Presidency of the Council of Ministers had intervened in the case which, as anticipated at the time by time.news, had rejected Rai’s refusal with a provision in which the Access Commission considered “the appeal well founded and therefore worthy of being accepted”. inserting the request for votes “in the context of the statutory purposes of the associations themselves, in relation to the interests of the consumers they represent. This is in order to ensure that the transparency and regularity of the voting operations have been respected, also in relation to the provisions of Agcom on televoting, referred to by the appellants”. The Commission had therefore ordered Rai to re-examine the application and show the two associations the requested documents.

In the following months, however, Rai did not provide Codacons with the documentation and so the Association has now decided to present a new complaint and a new request for re-examination. In the document, which time.news has read, the Consumers’ Association asks the Public Prosecutor’s Office to “use every investigative tool permitted by law and by ritual in order to prepare all the necessary checks to first ascertain compliance with the reality of the facts reported by the media and the carrying out of the necessary and rigorous investigations and verifications to ascertain the possibility of configuring cases such as the pep crimes pursuant to articles 328, 323 and 650 of the Italian Criminal Code and any criminal case that is identified by the Sv requesting the exercise of the prosecution of those found responsible”.

In relation to these facts, the Codacons statement continues, the Association “declares its status as an offended party, reserving the right to promote, in the forms and with the methods prescribed by law, the establishment of a civil party in the criminal proceeding which eventually should be established as a consequence of this deed, in order to obtain compensation for all damages suffered and to be suffered as a result of the criminal behavior reported”.
