The deputy of the Republican Bloc Malick Gomina raised his voice last Monday, following the presentation of the report of the law commission on the modalities of distribution of seats within institutions external to the National Assembly. He was indignant at this to the point of implying that the BR deputies refuse to be “companions to our friends from the UP Renouveau. “I would like to tell the commission that it was content to target the decisions of the Constitutional Court, in particular the Robert Dossou Court. It relied on this case law, even though the Amouda Court, in its decision 23-054 of March 9, 2023, relaxed the Robert Dossou case law. I would like to evoke here a concept of the Court Conceptia Ouinsou, the concept with constitutional value of the political configuration of the national assembly. It was the Conceptia Ouinsou Court which first introduced it into Beninese positive law. And the national assembly took over in its rules of procedure in force. The internal regulations of the National Assembly are part of the block of constitutionality and the first source of law is the law. Case law is a secondary source. This is why I would like to ask the committee to refer instead to the notion of the political configuration for the distributions to be made at the level of the National Assembly. I say this on behalf of the deputies of the Republican Bloc, since we refuse to be complementary to our friends from the UP Renouveau. We are a whole political entity. You should have seen our confrontations on the ground during the elections. Today, we ask that we go to complete them so that when they finish eating, they leave us the rest. We refuse this. Mr. President, you must take into account the Republican Bloc as being a political entity present in this assembly. And that is why, by evoking articles 86.2 and 86.4, I would like to ask to return to the committee and to change the principles on which it is based to make proposals at the level of the national assembly…”
