The Superior Court of Xustiza de Galicia (TSXG) will hold the appeal hearing on Monday in the case of the man who suffocated to death his three-year-old nephew in Santiago. the condemned, Santiago Cepeda Quintelawhom a popular jury found guilty, was sentenced in February by the Provincial Court to reviewable permanent prison.
The defendant’s defense, led by Evaristo Nogueira, a criminal lawyer from Compostela, appealed the sentence, since it considers that Cepeda was not of full mental faculties when he committed the crime and was unaware of what he was doing, that is why he requested complete exemption from his criminal responsibility, which would allow him to leave prison and enter a special psychiatric center. It is this question that must now be resolved by the Galician high court.
The events for which Cepeda Quintela was convicted occurred at 7:45 p.m. September 21, 2020, in his parents’ house, located in the north of the historic center of Compostela. The defendant accompanied his nephew to a bathroom located upstairs from the house. Once there, he closed both the access door to the upper floor and the toilet, the first with a key and the second with a bolt, and there cover the child’s nose and mouth with one hand and held his neck with the other until he died by suffocation.
The jury declared proven that the minor he had no chance to defend himself and that he trusted his uncle. He also denied that Santiago Cepeda presented a serious impairment of his mental faculties, for which he had the ability to understand the nature and consequences of his acts.
