Dhe property tax does not come from the negative headlines: For months, the tax returns that all property owners had to fill out and who had a hard time with it were annoying. And since then, the notifications that the tax offices have created on the basis of these declarations and are sending to the citizens have caused a stir. Because the properties were often valued much higher than before. This increases the fear of a significant increase in property taxes.
Many citizens responded with an objection to the decision. And what started out hesitant has turned into a big wave. “The vast majority of our clients are now objecting to the property tax assessments,” says Heinrich Fleischer, partner and tax consultant at the auditing firm EY. There are now more than three million objections to the tax offices – with a total of more than 30 million property tax returns submitted. The authorities are increasingly unable to cope with this. “We have reassigned staff internally in order to be able to cope with the high number of objections,” says Holger Kriebel, deputy head of the Mainz tax office. “We have suspended objections that claim that the property tax law is unconstitutional.” This means that they will no longer be processed until a court has made a decision – ultimately in a few years the Federal Constitutional Court will probably do so. The decision remains provisional and not binding.
