They won’t cut it. The Council of State, in a decision published this Thursday evening, gives the government two months to establish the technical control of two wheels. Faced with the inertia of the government, which is slow to put it in place, despite a previous decision of the Council of State of October 2022, several environmental associations had again seized the highest administrative court.
The Minister Delegate for Transport Clément Beaune reacted immediately after the decision, affirming that the government would apply “of course the decision of the Council of State” and that he himself would specify “in the coming days the timetable and the methods of the technical control ” , in a press release.
The ministry “enjoins” to take the measure
“The Minister for Ecological Transition and Territorial Cohesion is enjoined to issue the decree implementing the decree of August 9, 2021 relating to the implementation of the technical control of motorized vehicles with two or three wheels and motor quadricycles within two months of the notification of this decision”, writes the Council of State in its decision.
In their application to the Council of State, Respire, Ras-Le-Scoot and Paris Sans Voiture asked the administrative judges to condemn the State to a final penalty payment of one million euros per day of delay in the implementation of the decision. This was not retained.
