The EU Commission had taken Poland to the Court of Justice because a number of provisions of the Polish judicial system violated EU law.

She accuses the national-conservative government in Warsaw of curtailing the independence of the judiciary and undermining the separation of powers. There have already been several decisions by the ECJ on this.

In April 2021, the Vice-President of the Court of Justice imposed a daily fine of one million euros on Poland in the proceedings for interim relief.

With a decision of April 21, 2023, the daily fine was halved to 500,000 euros after Poland had abolished changes to the law, above all about the controversial disciplinary chamber for judges.

According to EU Justice Commissioner Didier Reynders, these changes are not enough. “Despite a number of important positive changes, serious reservations and concerns remain,” Didier Reynders told the European Parliament at the end of last week.

To date, Poland has not complied with the requirements of the European Court of Justice to ensure the independence of the courts.
