The Constitutional Court admits the appeals of Chaves and Griñán for processing

The Constitutional Court has admitted for processing the appeals of José Antonio Griñán, Manuel Chaves and the rest of those convicted in the ERE case of Andalusia. The Second Chamber considers that at this stage of the procedure “the credibility of the violations of fundamental rights alleged by the appellants cannot be ruled out.”

It also appreciates as reasons of special importance because “it raises a legal issue of relevant and general social repercussion and that has general political consequences.” In addition, the magistrates have rejected the very precautionary measures to suspend the sentence requested by the former president of the Andalusian Parliament, José Antonio Griñán.

This is a procedure prior to studying their convictions. Of all those sentenced to prison, only Griñán is still free pending a new coroner’s report. The latter advised against entering a prison for the former president of the Board due to his medical situation, he is being treated for prostate cancer. In this way, the Institute of Legal Medicine must specify if his ailment is very serious and compatible with his admission to jail.

This decision of the Constitutional Court was known on Monday morning with the votes against by magistrates César Tolosa and Enrique Arnaldo. They consider that the appeals for amparo “should have been inadmissible for processing because they lacked special constitutional importance as a mere question of ordinary criminal legality was raised” regarding the interpretation of the articles of the Penal Code that typify the crimes of administrative prevarication and embezzlement.

A task that, they insist, “is the exclusive responsibility” of the Criminal Chamber of the Supreme Court.
