The internship period is usually the first contact for many students with the labor market. In order to avoid precariousness and eventual contracting abuses by companies, a new Scholarship Statute has been drawn up.

At the moment it is a principle of agreement between the Ministry of Labor and the two most representative unions -CC OO and UGT-, from which the CEOE employers have been left out due to discrepancies in its content. The new regulations are expected to be approved, probably through a royal decree law, before the next general elections on July 23.

In the absence of specifying some points, these are some of the document keys:

  1. Limit on the number of practice hours

One of the novelties regarding the statute still in force is that the new one will limit the duration of the internships: they may not exceed 25% of the total time of credits in the degree that the student is taking, with a maximum of 480 hours per course.

The vice president of the CEOE and president of the ATA federation of self-employed workers, Lorenzo Amor, believes that this limit on hours, as well as the increase in bureaucratic procedures, “will harm the practical training of students.”

  1. Limit of interns per company

The new document contemplates putting a cap on the number of interns who can do internships at the same time in the same company, so that it is more difficult to hide a precarious job. This limit will vary depending on the number of employees of each company, but in any case may not exceed 20% of the workforce.

  1. Fines of up to 250,000 euros

There will be an “effectively dissuasive” penalty regime, as he assured this UGT newspaper, for breaches of the new Statute. The fines range, for minor infractions, between 7,501 and 30,000 euros; from 30,001 to 120,005 in medium grade, and up to 225,000 euros in its maximum grade.

  1. Delimitation of extracurricular practices

The unions were in favor of eliminating extracurricular practices. That is, those that are not part of the study plan and that the student performs voluntarily. It has been one of the main points of friction with the bosses. It seemed that they were going to achieve its suppression after the CEOE distanced itself from the agreement, but finally they are maintained in the new Statute.

However, extracurricular internships will be limited to those carried out “during official undergraduate, university master’s or, where appropriate, doctoral studies, which do not exceed 15% of the hours in which the ECTS (European Transfer System) credits are completed. of Credits) of the degree”.

  1. Financial compensation for labor expenses

It is more or less frequent that the interns have to pay the expenses related to their work in the company, such as travel, maintenance or lodging or per diems. The new Statute contemplates that companies cover them “for a sufficient minimum amount”.
