The Prosecutor’s Office refuses to investigate John Laporta already John Gaspart for disloyal administration in the Negreira case. In a letter sent to Investigating Court 1 of Barcelonaand to which this newspaper has had access, the prosecutor maintains that there is “not the slightest indication” that none of them, as presidents of Barça, acted in concert with Sandro Rosell or Josep Maria Bartomeu, and for this reason they opposes the request of one of the private prosecutions, which claimed to extend the investigation to the period between 2001 and 2010, which would affect both leaders.

“Assuming the applicant’s thesis would be as much as trying to criminally answer some people for allegedly criminal acts, committed by others,” says the prosecutor in the text sent to the instructor, Silvia López Mejía. He thus defends that the different meetings of the FC Barcelona «They acted according to their own criteria and based on specific circumstances, inheriting only the club’s statement of accounts, in the situation in which they found themselves once the outgoing board ceased; there is no succession in allegedly illegal actions, alleged crimes are not inherited », he abounds.

In other words, it cannot be understood that all the members of the different club boards can form a kind of consortium that assumes the criminal responsibility of the previous ones and the following ones. «Each board of directors made its own decisionswithout the respective presidencies having the opportunity to participate in those taken by previous or subsequent meetings.

Each one, maintains the representative of the Public Ministry, could “dominate” their own actions, and “only each one of them, individually, could have been able to avoid the consequences – harmful or not – that they could unleash.”

Person of the Barça

In addition, the prosecutor has also opposed the fact that the Barça, in addition to being investigated, appears in the case as harmed by the crime of unfair administration. He maintains that this crime, in the complaint of the Public Prosecutor’s Office itself, is attributed to specific and identified persons. “It seems evident that the status of investigated and the procedural consequences that derive from it and that only apply to it, are incompatible with the simultaneous position of accuser,” he settles.

Now it will be the judge who will have to decide whether or not to accept Barça’s request.
