The administrative court rejected the request of the Ministry of the Interior and the municipality of Ouistreham (Normandy) concerning a decision of the administrative court of Caen asking the local prefect to create “in the immediate vicinity” of the migrant camp water, toilets and showers. In an order dated July 3 and communicated overnight and Tuesday to Wednesday, the Council of State therefore confirmed the obligation to put in place the system requested by several associations.

“Contrary to what the municipality and the minister maintain, the presence of public toilets, located nearly a kilometer from the camp, and whose water point does not allow the filling of water tanks (…) cannot be considered sufficient to meet their basic needs in terms of drinking water supply and hygiene”, argued the judge in chambers in his decision.

Violation of a “fundamental freedom”

“Such living conditions show that the consideration by the public authorities of the basic needs of the migrants present (…) remains manifestly insufficient and reveals a deficiency likely to expose these people, in a characteristic way, to inhuman and degrading treatment. , causing a serious and manifestly illegal violation of a fundamental freedom”, ruled the Council of State.

He recalled that in the absence of these devices, dozens of migrants were forced to resort “to alternative solutions presenting risks to their health and physical safety, such as the use of water from the canal adjoining the camp.
