In the context of the increase in insecurity rates in Chimborazo and the country, a better job of THE POLICE is urgently needed, we set out to generate solution proposals, this understanding that security is everyone’s responsibility. In this sense, we address the deficiencies that exist in the legal field, with the criteria of the lawyer Diego Garcés.

Perhaps the work of the judicial function has influenced in some way the increase in insecurity?

No, rather it is due to the lack of professionalization of the Police. The prosecution has the Police as a support entity. It acts based on the work carried out by the Police in the first instance, for example in flagrant crimes. Sometimes the police are wrong when preparing the report or carrying out the procedure, and this allows the lawyers who sponsor the defendants (presumed criminals) to use legal strategies that force the judge to determine possible measures. Corrupt judges and prosecutors are heard, but many times it is not their fault. The judges cannot rule beyond what the prosecution has requested, and the prosecution cannot act beyond the facts that the Police have made known to it. For me there is an error in the Police procedures, which means that judges and prosecutors cannot act in a probable manner, since they cannot deviate from the Law.

Is more laws needed?

No, the laws that exist in the Comprehensive Penal Code, which regulates criminal offences, are adequate. Rather, the police and prosecutors should be professionalized, so that they can identify the contras and possible crimes, so that their actions are in accordance with the law. Currently, police officers graduate in six months; Imagine if those who graduated in two years were not prepared. A true professionalization of the Police is required. I say this because I worked with police officers.

Is it necessary to improve the effectiveness of judicial processes?

For me judicial processes are effective. There is a procedural error in the way of determining when the process is carried out by the Police.

Is it necessary to follow up on the work of law enforcement?

It is necessary to provide more intelligence to the police elements, since they are the backbone of the processes. Because as in any institution there will always be people who are corrupted. In this sense, it is very necessary and important to follow up on the work carried out by law enforcement.

Is it necessary to purge the bad elements of public security?

Previously, there was total control of the elements of the National Police and the judiciary, through the corresponding agencies; Unfortunately, all that has changed. Lately, news has been published in which we found out that police officers have been accused of different crimes, including robbery, and have been reintegrated into the ranks of this State institution. This action allows this type of person not to fully fulfill their role and duty, which is established in the Constitution of the Republic.

How important is it to promote justice that is close and efficient to the community?

A justice system that is close and efficient to the community does currently exist. It is so easy to go to the prosecutor’s office and report, either by a lawyer or a private person. I repeat again, impunity is often generated by changing crimes that are flagrant to not flagrant, since, on occasions, there is a lack of procedural momentum either from the Prosecutor’s Office or from the victim. In this sense, more prosecutors should be expanded so that they can know the causes and clear them up.

How much does the situation of the penitentiary rehabilitation system influence insecurity?

It is an open secret that within the prisons there is no social reinsertion as established by the Constitution of the Republic, when a person is arrested and admitted to the detention centers. On the contrary, we have seen with great sadness how these places have become universities for crime and true strongholds for organized crime, where criminals are safer than outside. They have police guards and they themselves manage the chaotic prison system; In this sense, there should be an urgent reform related to the issue of deprivation of liberty, since the issue of insecurity is being born from prisons. Within these places there are fortresses and armies of criminals and from there they operate in full view and patience of the entities in charge of control.
