A court in Arrecife forgives a couple a debt of more than 300,000 euros originated by abusive loans

The Court of First Instance 2 of Reef has forgiven one debt of 308,716 euros to a couple from the Lanzarote capital in application of the Second Chance Law.

According to the Bergadá Asociados law firm, located in Agramunt (Lleida), this couple was unable to make payments on several loans and credit cards with abusive interest rates and declared insolvency.

The debts began in 2011. “With what is now my ex-wife, we began to request loans through credit cards to solve setbacks, but we did not end up closing them due to abusive interest. We separated and I met the one who is currently my partner, but I was dragging her without realizing it towards the insolvency that I already had”, comments the man. “We always asked for loans with the intention of paying off others, thinking that it was the correct way to do it, but the ball of debts kept getting bigger and bigger,” he adds.

The lawyer and founding partner of Bergadà Asociados, Marta Bergadà, recalls that “they were in a very complicated and desperate situation. They did not know what to do and the debts were drowning them. We analyzed their case and saw that it was possible for them to be granted the exoneration of the dissatisfied liability, so we began to fight to obtain it”.

The road has been “plagued with obstacles”, admits Bergadà. “Initially, numerous embargoes began to reach us, especially from payrolls. There were also lawsuits and executions that led us to despair”, comments the client of the Lleida law firm.

“We suffered firsthand the harassment of the banks. There were innumerable calls we had every day on our phone. But, in addition, they also called my parents’ house, my brothers and our workplace. They even threatened us saying that if we didn’t pay the debts they would send a person dressed as a clown to be shouting from the street day and night that we owed money”, he laments.

“We live in a town where we all know each other and I have been working in the public administration for 17 years, so in the end everyone knew about our situation. Luckily, we have always received a lot of support. What’s more, we are both people with disabilities and, also, during this period of time my wife suffered from cancer, but they didn’t even respect that we were in the hospital. All of this has brought us closer together as a married couple.” For his part, Bergadà states that “these are very complex situations that banks do not consider. They only have their eyes fixed on the debts without thinking about what is behind them”.

After several judicial twists and turns, the debt exoneration order was issued on June 15. The resolution allows the couple to keep their home. “Until now we have lived with the sensation of living on the margins of society, as if we did not belong to it. We do not wish this suffering on anyone. Our character changed and we didn’t feel like doing anything due to all the obstacles we’ve had to overcome, but all of this has brought us closer, since when one couldn’t take it anymore the other pulled him. Now we can go out into the street with our heads held high, knowing that we have no debts, and start living again, as if we were breathing fresh air. We live again, ”he concludes.

The lawyer Marta Bergadà indicates that “it has been one of the most complex cases that we have had to face, but in the end everything has been resolved as we expected, since they are debtors in good faith.” In addition, she recalls that “ignorance of the Second Chance Law is one of the main problems that currently exist. It is necessary to make it known and that all of us who are involved fight for it and train ourselves to help all the people who are in a situation of insolvency and are having a really bad time”.
