It was a very bad choice that this prisoner made when – last December – he decided not to return to the apartment from which he benefited within the framework of an external placement. For some months, he had been living in Aulnay-sous-Bois (Seine-Saint-Denis) alongside another prisoner, with whom – obviously – the cohabitation was very bad.

It is therefore for escape that this 22-year-old young man – without a real home – was tried by the Meaux criminal court on Thursday. He was also appearing for trespassing. And for good reason: after a few months spent “in nature working on the black in masonry and restoration”, he was arrested by police officers from the Meaux police station, last Sunday, as he was leaving an “unoccupied” house. in Meaux, with a friend. The officials had been mobilized by a call made to 17, evoking a possible burglary.

From the court box, the defendant explained his motivations perfectly well, as well as the sequence of his bad decisions: “I left the outside placement because I was afraid. I had just been told that I was going to go back to prison and I was very, very scared”. It is that in December 2022, during yet another appearance before a court, he understood that two previous convictions of six months each were going to “fall”. An unbearable outcome for him, especially since he did not have much time left before his release.

Another motivation for taking to their heels: he could no longer support his fellow prisoner. “It’s a combination of circumstances. The young man I was living with was bipolar but he was not taking his treatment. We were fighting every day, ”said the defendant. Before also mentioning a family problem: at the time – and still today – his mother was in palliative care and his sister was encountering personal difficulties. A painful situation for him, even if he was placed at the age of 13 in a home for social assistance for children (ASE), after the death of his father. “Since I was 16, I’ve been on my own,” he said.

The rest of his career did not go much better, since the young man now has a strong criminal record of 16 convictions. The night before his arrest, he had been drinking and taking drugs after attending a music festival. “With my friend, we thought the house was abandoned. I have no excuse, it’s pitiful, ”he said.

“My client told you, he is afraid of justice. Because he knew her very young, when he was placed. Afterwards, he had to manage, he rubbed shoulders with friends in the city, who allowed him to receive a small ticket. And then he got into traffic. But the precariousness continued because that is not what gives a roof and a social base, ”described his lawyer Me Jean-Louis Granata.

Before mentioning a certain “slowness of justice”, which would have created an unbearable situation for his client: he was going to find himself again behind bars, after having benefited from an outside placement. Me Granata tried to suggest to the judges to pronounce a sentence of semi-freedom. In vain. The court sentenced the defendant to three months in prison for the invasion of domicile and six months in prison for the specific offense of escape. Following the requisitions of the prosecution. The young man was imprisoned after the hearing. “My mother must not die during this period,” he said before leaving the box.
