On Monday, Hamburger Sparkasse (Haspa) appealed to the Hanseatic Higher Regional Court (OLG) in all three proceedings relating to the burglary of the safe deposit box in the branch in Norderstedt. This was already announced after the verdict was announced by the Hamburg Regional Court on June 29 and has now taken place after a detailed analysis of the reasoning for the verdict, said Stefanie von Carlsburg, spokeswoman for Haspa. During the spectacular burglary with heavy equipment through the ceiling of the apartment above into the vault in August 2021, around 650 lockers were broken into.

The contents are automatically insured for up to 40,000 euros per subject, says von Carlsburg. Haspa thus offers a high level of included insurance protection compared to the competition. The insurance company did not question the protective measures and compensated all those affected up to this amount in the previous year. Customers who would have wanted to secure values in their locker that went beyond this could have taken out inexpensive additional insurance. It was an individual decision to do without it – for example for reasons of cost.

In the legal dispute over compensation payments, the district court had largely upheld the complaints of three affected customers and ordered Haspa to pay a total of 278,000 euros, since the security measures taken for the locker system were insufficient compared to the obligation to “safety-safe” (FAZ from July 7th, ). After these decisions, the Sparkasse could not invoke the maximum liability limit of 40,000 euros contained in the contractual conditions for lockers, a court spokesman said. According to the Hennemann law firm representing them, the customers were awarded a payment of EUR 110,000, EUR 100,000 and EUR 68,000 respectively.

“The accusation, which we cannot understand, that the security technology installed in the branch was not sufficient, is one of the main reasons for our appointments,” says von Carlsburg. The built-in motion detector is a product of the highest security class with a certification recognized at the time of the crime. Higher quality approvals are not known either in Germany or in Europe. From the point of view of the Sparkasse, the requirements in the grounds of the judgment that go beyond the existing security measures are neither practicable nor comprehensible. For example, the constant use of security guards or a video system in the strongroom, which is required, is not permitted by the special protection of discretion in the locker systems alone.
