Appio remains in the sights of the TRF-4

In a unanimous decision taken this Monday (24), the Special Administrative Court of the TRF-4 (Federal Regional Court of the 4th Region) opted to initiate a disciplinary administrative proceeding against Judge Eduardo Appio, who has been away since May from his duties at the 13th Federal Court of Curitiba, responsible for the criminal proceedings of Operation Lava-Jato. Additionally, the Court also decided, by majority, to keep the magistrate away from his attributions.

The suspicion against Appio arose after he allegedly made a threatening call through a blocked number to lawyer João Eduardo Barreto Malucelli, son of judge Marcelo Malucelli, former rapporteur for Lava-Jato appeals at TRF-4. In addition, the judge is also accused of having leaked João Eduardo’s personal data, obtained through consultations with the internal system of Federal Justice.

The average time for the duration of the administrative process is 140 days, with the possibility of extension. Since last month, the 13th Federal Court of Curitiba has been led by judge Fábio Nunes de Martino, who took over the post after the departure of Gabriela Hardt, who joined the 3rd Appellate Panel of Paraná.

Appio was removed from his duties on May 22, when he also had his entry into the building of the 13th Court of Curitiba prohibited, being forced to return his functional cell phone and computer. Such removal had the purpose of producing evidence to support the opening of the administrative process.

According to the report presented by the regional corregidor Cândido Alfredo Silva Leal Júnior to the Special Court of the TRF-4, a call made to lawyer João Eduardo Barreto at 12:14 pm on April 13 from an unidentified number was reported. This phone call took place minutes after Appio accessed a process in which the lawyer represents Rosângela Moro, wife of Senator Sérgio Moro (União-PR). João Eduardo is a partner of the couple.

The interlocutor on the call introduced himself as Fernando Gonçalves Pinheiro, claiming to be a servant of the health area of ​​the Federal Justice. However, after investigations, the TRF-4 found that there is no server with that name in the body.

Federal Police experts carried out an investigation that indicated that the comparison between the voices of the person who spoke with João Eduardo and that of Judge Eduardo Appio “strongly corroborates the hypothesis” that it was the judge who was on the other end of the line.

In the conversation, the alleged servant of the Federal Court mentioned the existence of a residual value of the Income Tax available to the judge Marcelo Malucelli, father of João Eduardo, suggesting that he contact his father directly for information on the issue.

João Eduardo suspected the connection and recommended that the alleged server call his father directly. In the end, the man asked the lawyer if he’s sure he hasn’t “up to anything”.

The Federal Justice inspector in the 4th Region considered the suspicion that Appio had impersonated another person to threaten or intimidate another person as a serious matter.
