The Mexican Senate approved, last March, the Federal Labor Law to extend the leave for breastfeeding and to go from the current six months to two years. If this measure is approved, Mexico would become one of the few countries in the world that offer a two-year lactation permit.

What is the lactation leave in Mexico like so far?

Mexican mothers can have, for six months, two half-hour breaks a day to feed their children in a suitable place designated by the company. If this is not possible, they can reduce their working day by one hour.

The new proposal

The reform proposes that Mexican mothers can request, for two years, measures of flexibility in their working hours and, in extraordinary cases, take their children to the workplace, provided that the integrity of the minor is not put at risk and with prior agreement. with the company. The law also asks companies to guarantee adequate, hygienic and private spaces for breastfeeding and establishes that the dismissal of employees during this period is avoided.

Entry into force of lactation leave

The reform arises in the Senate itself and after its approval it must go to the federal Chamber of Deputies for its approval, where it is now under review within the Labor Commission of the Chamber of Deputies.

This means that the reform of the Law will not be immediate. But beyond how long it may take to be in force, the important thing is that it represents progress so that Mexican mothers do not have to stop extracting breast milk or breastfeeding at work, in the few cases that this It is possible, in addition to the fact that they will not be fired for making use of that right.
