On the basis of the rules dictated by the Civil Code there are some subjects who are heirs by law and to whom a certain portion of the so-called “legitimate” inheritance must go. Basically, even by making a will, the subjects protected by the legitimate must still obtain the quota established by law and cannot in any case be disinherited by making a will. Only the following are entitled to the legitimate: spouse, children and parents, if the children are not there.
