► Be the owner of your home

Tenants can put their accommodation on the platform but must inform their landlord. They cannot rent more than the amount of their own rent. On the other hand, renting is not authorized for people residing in social housing.

► No more than 120 days

The owner cannot rent his accommodation for more than 120 days per year. When they are reached, the Airbnb site automatically closes its schedule on the site. This limit, which came into effect on January 1, 2019, was imposed by the most touristic cities with the aim of regulating short-term rentals, which take precedence over long-term rentals.

Two exceptions: the rental of a room in a main residence has no time limit and can therefore take place 365 days a year, just like a secondary residence, provided that you have declared your rental activity to the city ​​hall.

►Register your accommodation with the city

In some cities, it is imperative to register your accommodation as tourist accommodation with the city since the entry into force of the law for a Digital Republic and the Elan law. Owners receive a registration number that must be indicated on the Airbnb site. This allows town halls to follow the 120-day regulations and to establish sanctions, if necessary.

But, here again, it is not necessary to register your accommodation if the rental concerns only one room within the apartment or the house.

At the beginning of 2023, four parliamentarians from different groups proposed a series of measures to better regulate the short-term rental offer on the platforms. In their sights, the drop to 90 days of rental per year, the ban on the rental of thermal colanders and the reform of the tax niche for furnished tourist accommodation.

An interministerial working group dedicated to furnished tourist accommodation also submitted its proposals to the delegate ministers in charge of housing, in mid-July. Among which, the possibility for more than 2,000 new municipalities to establish regulations for the rental of furnished tourist accommodation.
