Fraud crackdown nabs four influencers

DISPATCH — Counterfeits, “plumping” of the lips, sports betting … The Directorate General for Competition, Consumer Affairs and Fraud Prevention (DGCCRF) asked four influencers this Thursday, August 10, to “stop misleading commercial practices on their social media.

Mélanie Orlenko, Gulfer Taskiran and Amandine Pellissard were pinned for having deceived “the consumer about the legality” of a service: the “plumping” of the lips. In other words, injections of hyaluronic acid “by a provider who does not have the required qualifications”, which promises young women new luscious lips.

As AFP reports, Mélanie Orlenko has 778,000 followers on Instagram (@melanie_orl), Gulfer Taskiran, 488,000 followers (@feli-ccia) and Amandine Pellissard 372,000 people (@amandine.pellissard.off). The fourth, Fanny Sanial, has 341,000 subscribers on Youtube (@FannySNL).

They promote products or services on Instagram, Snapchat, TikTok or YouTube, and get paid for it. The problem is that they rarely know the products they rent, and regularly forget to indicate the advertising nature of their videos. Among other facts, Ms. Orlenko was accused of “promoting sports betting advice based on “performance and success claims” that are misleading to the consumer.

For her part, Ms. Taskiran attributed to cosmetic products “properties and results” not “demonstrated or justified by conclusive, verifiable and available elements”, communicated a false origin for food products, and presented counterfeit clothing without the announce.

The repression of fraud thus ordered them to “stop these practices” and “to comply” with the Consumer Code.

Since the beginning of June, the DGCCRF has issued several injunctions against influencers, in parallel with the adoption by Parliament of a text regulating their practices.

The text notably prohibits the promotion of cosmetic surgery and prohibits or strongly regulates the promotion of several medical devices. It also tackles sports betting and gambling.
