Land: in Parakou, the municipal authorities raise public awareness of the applicable rules

From this day, Monday August 14, 2023, the sale of real estate without a land title is no longer authorized in Benin. It is as a prelude to the entry into force of this important change that the Department of State and Environmental Affairs of the Parakou Town Hall initiated a meeting to enlighten public opinion on the new administrative procedures for land transactions.

The director of land and environmental affairs at the town hall of Parakou provided the necessary details to the participants. “If you want to sell your land, you must have the land title, as of August 14, 2023. If you buy land, the formalization must be done through the notary”, clarified Boris Gbènakpon.

What are the documents to provide?

Several documents are requested from the seller of land to obtain a land title. It’s necessary:

– a topographic survey or simple plan;

– an act of presumption of ownership

– a request form for confirmation of rights;

– a requisition form;

– a provision (5 copies of the provision receipt).

The Municipal Domain and Land Offices (BCDF) of the ANDF are competent to issue these documents to any individual who requests them.

Faced with erroneous information relayed on social networks concerning the new provision, the Director General of the National Agency for Domain and Land (ANDF) provided some clarifications. “No text has provided for the systematic conversion of citizens’ land assets into State heritage for failure to obtain the certificate of customary detention from August 14, 2023”‘, said Victorien Kougblénou

August 13, 2023 marks the end of the transitional period with regard to the Land and State Code. The provisions of article 516 of the said code authorized over a period of 10 years transactions on real estate without land titles. A derogation from the principle affirmed by the law in its article 17 which makes the confirmation of land rights, in this case the land title, a condition for selling a plot of land.
