Pensions: what do the new decrees published in the “Official Journal” contain?

More than a few days. The very controversial pension reform comes into force on September 1 and, in the meantime, the implementing decrees follow one another. Two of them have just been published in the Official Journal. They aim to “take into account career breaks [et à] correct the injustices of the past”, details the Ministry of Labor in a press release. Of the 31 decrees planned as part of this reform, almost all have been published.

A bonus for mothers and fathers

The two decrees published Tuesday, August 22 engrave in law the premium for mothers and fathers. A hobbyhorse of the Republicans, this measure is supposed to correct the injustice suffered by parents, in particular mothers, considered so far as the big losers of the reform. To rectify the situation, the government is proposing a premium of 1.25% per quarter.

Concretely: mothers and fathers of families who have had at least one child and a full career (i.e. their 43 annuities) before the legal retirement age will benefit from a premium of 1.25 % per quarter. It will amount to a maximum of 5%. Daily maternity allowances will also be taken into account in the reference salary.

Consideration of TUC contracts

The decrees will also make it possible to take into account contracts for collective utility works (TUC), hitherto left out in the calculation of rights. Nearly 1.7 million people signed this type of contract, introduced between 1984 and 1990.

Young volunteer internships, those practiced in companies as part of the Barre plan and initiation to professional life, as well as local integration programs (PIL) will also be included in the calculations.

Relaxation of the redemption of quarters

The decrees also provide for the relaxation of the redemption of terms for internship and study periods. A request for payment of contributions for an internship can now be submitted until the insured is 30 years old, instead of the second year following the end of the internship so far. With regard to higher education, the redemption of terms may be carried out until the insured is 40 years old, instead of the tenth year following the end of studies.

Improvement of the rights of top athletes

Finally, the two decrees refer to the rights of top athletes. Their number of terms, which can be validated, will double, going from 16 to 32.
