The Public Ministry also sanctioned in the first instance three former health development secretaries of the department. They are Alexis José Gaines Acuña, and Alfredo José Aruachán, for 9 years; while for Edwin de Jesús Preciado for a term of 8 years.

In the specific case of Lyons, the entity concluded that he did not monitor the powers of those who served as Health Secretaries, who caused that million-dollar payment for the provision of services for neurodevelopmental therapies to the low-income population not covered by the POS. , specifically in the agreements between the territorial entity and the IPS Crecer y Sonreír SAS, Semillas de Amor SAS and Girasoles SAS

On the other hand, in the case of Gaines Acuña, the official, through two resolutions issued in 2014, ordered the payment of health rehabilitation services for $1,193,930,000 in favor of IPS Girasoles and Crecer y Sonreír. The problem is that there were previously no legal transactions between the government and the health service providers.

In the same context, the other secretary, Aruachán Narváez, through ten administrative acts, ordered approximately $6,064,044,000 to be paid in 2014, in favor of the three aforementioned health service providers, without there being a contractual process. .

And on the side of the official Preciado, the Attorney General’s Office was able to determine that for the year 2015, “he ordered the payment in favor of the IPS Girasoles of $628,600,000, omitting the stages required by law to carry out voluntary agreements.”

Due to these facts, the Delegate Disciplinary Prosecutor’s Office 2 concluded that there was a violation of the principle of economy and responsibility in the exercise of contracting functions. Likewise, in the ordering of spending, “by having the departmental budget, without complying with current legislation on social security in health.”

The offenses committed by the officials were classified by the Public Prosecutor as very serious, by way of very serious negligence. Copies will be certified to the General Prosecutor’s Office. This decision is subject to appeal before the Disciplinary Chamber for Judgment of Public Servants of Popular Election of the entity.
