Lula’s arrest was “one of the biggest judicial errors in the country’s history”, says Dias Toffoli

the minister José Antonio Dias Toffolido Supremo Tribunal Federal (STF), invalidated the evidence obtained through the leniency agreement signed by the Odebrecht. In his decision, the magistrate stated that the arrest of Luiz Inacio Lula da Silva (PT) in 2018 was “one of the biggest miscarriages of justice in the history of the country”.

The agreement between the Federal Public Ministry (MPF) and the company in question was signed in December 2016. The following year, it was approved under the scope of the operation Lava Jato by the then judge Sergio Moro (Union Brazil-PR).

In the determination, Toffoli points out that the evidence was obtained “on the margins” of the Law.

Previously, the defense of the current President of the Republic filed a lawsuit in the STFin which he requested the full access to the leniency agreement documents.

According to the minister, the reasons for his decision are goals and they are not only due to the appeal presented by Lula’s lawyers.

“Reason why the recognition of said worthlessness (annulment of evidence) must be extended to all facts (proceedings) that have used such elements, whether in the sphere criminalwhether in the sphere electoraleither in proceedings involving acts of administrative impropriety, or even in the sphere of civil“, scored.
