The CCJR (Constitution, Justice and Writing Commission) of the Legislative Assembly of Mato Grosso do Sul approved a favorable opinion on a bill by Deputy Coronel David (PL) that aims to oblige aggressors of women to reimburse public coffers for health treatment via SUS (Unified Health System) received by the victims.

The opinion was approved this morning and according to the text of the project, there is provision in the Maria da Penha Law for the measure to be implemented. “Thus, the Federal Law allows each federative entity to regulate this reimbursement according to the predominance of its public interest”, cites justification.

It also justifies, in defense of the project, that financial compensation “may serve as yet another factor to discourage the practice of violence against women in the domestic and family sphere”. Thus, it defines that “those who, by action or omission, cause injury, physical, sexual or psychological violence to women in situations of domestic and family violence, are obliged to reimburse all damages caused by the SUS, in accordance with the table of services provided for the full treatment of victims”.

The proposing deputy also recalls in the justification that when the victim is treated in the private network, there is already a legal obligation to repair the expenses to repair the injuries caused, but when it is done by the public health network, the aggressor is not called upon to indemnify these costs. This is precisely what the proposal seeks to balance.

Finally, the CCJR established that the project can move forward in the House of Laws and that there are no constitutional impediments that could prevent it from being applied, if it is approved.
