Federal Court Grants Emergency Stay in Texas’ Anti-Migrant Buoy Case

In a surprising turn of events, the conservative Fifth Circuit Court of Appeals has issued an emergency stay on the removal of Texas’ anti-migrant border buoys. This decision comes just a day after U.S. District Judge David Ezra ordered the removal of the 1,000-foot long string of buoys. The appellate court has not yet scheduled a hearing, leaving the fate of the buoys hanging in the balance.

The buoys were part of Governor Greg Abbott’s multi-billion dollar Operation Lone Star aimed at deterring migrants from crossing the border between Mexico and Texas. However, the federal government argued that the buoys posed a threat to public safety, impeded river navigation, and damaged diplomatic relations with Mexico.

In response, attorneys for Texas claimed that removing the barrier would harm the state’s self-defense from a “cartel invasion.” Judge Ezra, a Reagan appointee, labeled this argument as “unconvincing” in his ruling. However, the Fifth Circuit’s emergency stay now allows the buoys to remain in the waters of the Rio Grande while the Justice Department’s case against Texas is under consideration.

Governor Abbott has made it clear that he is willing to take the case to the U.S. Supreme Court if necessary. His office released a statement earlier this week stating, “We will continue to utilize every strategy to secure the border, including deploying Texas National Guard soldiers and Department of Public Safety troopers and installing strategic barriers.”

The controversial border security initiative has attracted attention from civil rights advocates, aid workers, journalists, and politicians. A group of these individuals recently inspected the line of wrecking ball-sized buoys, which Governor Abbott considers the centerpiece of Operation Lone Star.

However, immigrant rights activists and congressional Democrats are urging the federal government to intervene. Congressman Lloyd Doggett, a Democrat from Austin, described Abbott’s actions as relying on “cruelty and arrogance” as a deterrent while wasting taxpayer dollars.

As the legal battle continues, it remains to be seen whether the federal government will succeed in its efforts to remove the buoys and maintain control over immigration policy. For now, Texas’ anti-migrant border buoys will remain in place, pending a decision from the appellate court.
