Altori appealed the sentence to the Be’er Sheva District Court but his appeal was denied. His request for leave to appeal to the Supreme Court has now also been rejected and he will soon begin serving his sentence. The case was handled by Adv. In June 2021, the Magistrate’s Court in Be’er Sheva sentenced the defendant, after admitting in an amended indictment that included three sections of failure to file income tax returns on time. The court found it appropriate to sentence the defendant to 8 months in prison, along with fines and related penalties. Who was previously convicted of failing to periodically report to VAT and the fact that until sentencing the defendant did not file the missing reports.

The defendant appealed to the Be’er Sheva District Court, but his appeal was denied. The district court judge noted that the fact that the defendant submitted the missing reports after the sentencing did not justify a mitigation of sentence and that the sentence imposed was reasonable, given that the companies owned by the defendant had a turnover of about NIS 12 million in those years.

Defendant sought leave to appeal to the Supreme Court, but his application was denied on two grounds. First, the Supreme Court judge who heard the motion noted that the leave to appeal in a “third incarnation,” that is, an appeal against the outcome of an appeal, is granted only in cases where there is a fear of miscarriage of justice, material injustice or in cases of appeal. The judge did not find that this case meets the same criteria.

Second, the judge held that the sentence was not exceptional in relation to the sentences imposed in similar cases and that all the considerations, including the personal and family circumstances of the defendant, were taken into account in determining the sentence. Therefore, the Supreme Court judge ordered the defendant to appear for sentencing on January 9, 2022.
