In the Citizen Attention Office from the Vigo courts usually arrive desperate parents who ask for help because they don’t know how to throw their son out of the house after becoming very conflictive. Some cases go to trial such as one in which the Hearing in Vigo has confirmed a Restraining order for a vigus who will not be able to get close to his elderly parents. The man is investigated by a crime of psychological abuse habitual towards his parents, with whom he lived until January. Now they prohibit him from residing with them or going to their neighborhood.

Apparently, he insulted his mother and bothered his father, who has reduced mobility due to a stroke he suffered years ago. On January 9, the couple left their home in a hurry due to the son’s aggressiveness, which is why the audience he sees a situation of clear risk for both parents and confirms the restraining order.

Two apartments for rent

The accused, a pensioner who receives rental income for two apartments he owns, considered that the measure was disproportionate and appealed against the removal of his parents. He alleged, in his favor, that he suffered from a mental illness that made him paranoid and aggressive. But the argument turned against him since, with even greater reason, the court believes that this disease, in any case, further aggravates the risk for his parents. And he adds that the fact that the son cannot return to the family home does not leave him on the street because he receives a pension and owns two apartments.

The incidents date back to January 9 when the sister went to visit her parents and witnessed an incident between the accused and her mother. The parent explained to him that she had continuous arguments and tensions with him. The court emphasized that the insults were directed especially against her mother, but the risk situation affected both of them. Finally, that day, the elderly couple left their home for fear of their son. Some time later, they sent him a burofax (certified mail that serves as legal proof) in both their names so that he would not return home. In addition to habitual psychological abuse, the Prosecutor’s Office attributed a crime of threats.

Two months later, on March 9, the Court of Instruction number 1 of Vigo issued an order that provisionally imposed a restraining order against the parents. The son appealed, considering it disproportionate.

The fifth section of the Court of Pontevedra, based in Vigo, had no choice but to agree with the judge in an April order because they see a clear risk in the home for both parents. She emphasizes that It is not an isolated episode, but they are events that have been repeated for years. He also rejects that it is a disproportionate measure if the age of the child and that he has his own resources is taken into account. The lawyer explained to the Court that the son is diagnosed with a mental illness that causes him to suffer from paranoia and that is characterized by distortions, especially in the perception of thought, and may at certain times suffer a crisis accompanied by certain violence, threats or even attacks on the person. relative with whom they live.
