A lawyer from Logroño faces three years in prison for allegedly defrauding a client of 3,680.4 euros by claiming amounts for a lawsuit he did not file.
As the indictment states, DNC was hired, as a lawyer, in May 2019 to file a lawsuit seeking damages.
In this way, he presented the client with fees, supposedly for the entire procedure, of 5,747.5 euros, of which he had to pay half at the beginning of the contract.
The client paid him 2,873.75 euros on May 22, 2019. Then, on June 13, the defendant contacted him again and explained that, to file precautionary measures, he had to pay another 1,652 euros and his client agreed. to pay 407.75 euros on June 19.
On July 31, the defendant informed him again that the attorney had already presented the lawsuit and the measures and gave him a complementary charge of 398.90 euros, “assuring him that the lawsuit had already been filed and that there would be no new expenses.” His client made the transfer on August 5, 2019.
Since then, he has not contacted the injured party again and the lawsuit has not even been filed, so the client decided to end the contract on January 13, 2020. He demands the 3,680.40 euros paid.
For the Prosecutor’s Office, the events reported constitute two crimes; one of fraud and another of harming the interests of his client.
He asks for three years in prison for the first offense (and a fine of eight months with a daily fee of eight euros). For the second, eight months of fine with a daily fee of eight euros and special disqualification from the practice of law for three years; in addition to compensating 3,680.4 euros for the amounts defrauded.
The trial is scheduled in the Provincial Court next Monday, October 2.
