The lawyer for the Teatre nightclub, José María Caballero, said this Tuesday in Más Vale Tarde that the venue “did not have a license.” Something that happened after the burned premises located in Las Atalayas, Murcia, was divided into two to rent the other part more than a year ago.

From this came the other affected nightclub, which is Fonda Milagros. However, in the eyes of the City Council, Fonda does not exist, because the division request was not accepted. “With all reservations since I have not had time to study the documentation, I understand that, indeed, the fact that the license that existed as soon as the distribution changes automatically entails the revocation of the license and, therefore, the cessation of activity,” said the lawyer.

“Although, it is true that when the Teatre room is notified of the cessation of activity because they do not meet certain requirements, a document is immediately presented proving that they are met,” the lawyer said. In fact, he points out, the City Council “has been sending a series of inspections.” “The last of them in March,” he stated, adding that they first came in February for a health inspection and that this “revealed the existence of a series of deficiencies.”

Then, in March, “they came and found that all of the deficiencies that had been revealed in February had been corrected.” Caballero has confirmed that, according to the information he has, the establishment “does have insurance.” On the other hand, he adds that it is clear that “the sound limiters are not like the ones that existed before.” “The sound limiter gave information to the City Council. This was fully operational,” he stated.

Asked if they are blaming the City Council, he was blunt: “I am not blaming the City Council, but I am saying that it was not a clandestine activity. It did not have a license as such because it had been lost.” “When the closure order was notified, they communicated that they did meet the requirements. It was proven with the engineer’s report,” added the lawyer.

So if there is a closure order, why was it carried out? “I can’t tell you. I’m sure they continued because they were absolutely complying with the regulations and they continued with the activity. It was a known activity and the City Council was aware on a daily basis of the level of noise that was being made. And, therefore, it was knowing that the activity was developing,” concluded José María Caballero.
