In 2020, around thirty plaintiffs took the State to court, accusing it of having contributed to the spread of Covid-19 because of muddled communication on masks and insufficient stock. They won their case on Friday October 6, the administrative justice having accepted on appeal partial compensation for the most exposed professions.

“The State committed a fault by not maintaining a sufficient level of stock of masks to combat a pandemic linked to a highly pathogenic respiratory agent,” affirms the Paris administrative court of appeal, in a decision which confirms a similar opinion rendered a year ago at first instance. Likewise, as reported by AFP, it confirms that “the State made a mistake in government communication on the usefulness of wearing a mask at the start of the epidemic”.

At the start of 2020, due to a lack of sufficient stock, the government assured that masks should be reserved for caregivers. Soon after, they were made mandatory. Ultimately, the country quickly found itself helpless, as did its health professionals, who were particularly exposed. Some complained.

The administrative court of appeal recognized “a right to partial compensation for people who, without being accused of risky behavior, have been particularly exposed to the virus, in particular because of their profession, even though they are not could maintain physical distance from potentially contagious people.

On the other hand, the court did not find fault on the part of the State on other accusations linked to crisis management, in particular on confinement or screening.
